The project by Norwalk-based Able Construction includes two duplexes and five single-unit structures set on a cul du sac accessible via Weston Road.
The subject of much neighborhood opposition, It had been scaled down from a 12 and then 11 units previously denied by the P&Z.
“The new application is fair and balanced,” said P&Z member Greg Rutstein, adding that it would have minimal effect on traffic.
Able Construction principal Peter Greenberg purchased the 2.2-acre property on which Daybreak Nurseries had operated for almost 73 years for $1,350,000 as the highest bidder in a foreclosure settlement in February 2014.
His company pushed for a text amendment that passed in September 2016 for 12, two-bedroom units not to exceed 2,400-square feet.
Able Construction had been back at the P&Z several times since, scaling down the development from 12 to 11 units, 100 percent of them age-restricted instead of the previous 60 percent, each selling for about $1.2 million.
The P&Z denied that application March 16 by a vote of 4 to 2. (See WestportNow March 16, 2018).
