Y Withdraws and Refiles P&Z Application; Hearings Extended
The Westport Weston Family Y, stymied by a legal deadline in its efforts to move its headquarters to its Mahackeno site from downtown, tonight withdrew its controversial special permit application to the Planning and Zoning Commission and then promptly refiled it.
The net effect was to restart the clock on the application, which by law the P&Z would have had to close public hearings on by the end of today. The commission agreed to take up the new application on June 23 or possibly later if all commissioners are unable to make a meeting on that date.
The action was announced by Y attorney Larry Weisman at the end of his summation on what many had expected would be the final day of two and a half months of public hearings on the application, which opened on March 13.
Weisman explained that in order to complete its application, the Y still needed to resolve an issue concerning a road abandonment on the property. The Representative Town Meeting (RTM) planned to take up the matter at its session on Tuesday night.
He said because of the new filing, the Y application now would also have to address a revision in the aquifer mapping of the Mahackeno area as approved by the Department of Environmental Protection.
Weisman expressed confidence that the new mapping would not adversely impact the application. He said it would also eliminate concerns raised by Y opponents that the Y had filed its initial application days before the mapping was to go into effect so it could avoid the issue.
P&Z Chair Ronald Corwin said all previous testimony would be incorporated into the new application.
He said the commission would do its best to complete its work on July 1 or 2 before some commission members become unavailable because of vacations.
